I got her working sort of she powers up and the fan runs a little stronger than the other day, she will run a arc for 10 seconds enough to get a puddle going than it trips the safety switch even at 80amps

The 30mA is the spec for the residual current side of things.
That breaker will trip for two reasons
1) Excess residual current, or current mismatch between earth and neutral from power draining away via an earthed component somewhere
2) Excess total current in the circuit.
If it is a residual current problem it will usually happen right away.
It sounds like it's a total current problem
The breaker should have something like C16 or C20 or D25 clearly marked on it.
The 16 or 20 etc is the max current the breaker can handle over an extended time period. It will be able to handle much higher currents for a short period to allow for things like start up currents.

I re-added the washers but i think i may have found the problem i edited one of the pictures, there is a blue wire going to the brown terminal and brown wire going to the blue terminal do u think its worth a try swapping them over?

I would suggest you've probably got it wired up correctly, and it's behaving exactly as I suggested it might...
Going back to an earlier post I made, mine would trip a 40A breaker at 180A output in more or less the same timeframe you're talking. My 40A divided by your 16A = 2.5, my 180A divided by your 2.5 times smaller breaker = 72A. Again repeating what I mentioned earlier, I highly doubt there is any significant difference in the efficiency of the transformers between our machines. Which means in theory at 60A or less, it won't trip the 16A breaker - limiting you to about 1.5mm material...
Given that you're in a rental property, I'd suggest its time to give it the flick, installing another dedicated line to power it seems like a massive overcapitalisation in a rental unless you're planning to stay there for a LOT longer. If you can get an inverter for $400-500, even if it gets stolen before you move out, you're still at the same net loss as running another line to the shed...

Yeah your right mate, i have looked at the Arc Pig $350 USD to be used on a old AC machine for welding aluminium but with conversion and shipping i'd probably be looking at the cost of a new Chinese machine
I have a job right now i could have used this tig welder on too such a shame, I will have to use the mig just my horizontal welds look sloppy lol

Stay away from the arc pig, all is not as rosy as it seems.
Realisticall you have one option. An inverter AC DC tig. Buy something reputable ( I remember the Mishto debacle ). Jasic machines perform well for what they are. Steer well away from the BOC smootharc machines. Everyone I've seen has been a problem child.
Remember, buying a decent machine, you only feel the pain once, a crap machine will cause you a lifetime of pain. A budget or around $1000 should well and truly get you in reach of a decent machine.

All those models would likely be picked up by someone robbing my shed Karl, We heard today by a neighbour that heard an old friends friend has been coming around to try steal our dirt bikes which is a big concern i only have a ordinary garden shed but i am also worried about the house getting broken into as well as we have a brand new dirt bike inside the house worth 15k i think this is the bike this person wants to steal, so any technology in the shed would be gone quicker than i can say where'd that go..
I most defiantly don't want to go down the Mishto path again... and i don't want another huge welder like the first AC/DC tig i had and than the Magnium 200 AC/DC welder those two had so many settings and knobs i got absolutely lost in all the settings i had no idea at all
Would ideally like to keep the settings as basic as possible,Gas flow, Amps thats it really as i need to focus all my attention to welding and positioning
